In a stunning legal development, Congressional candidate Eddie Egriu defeated Congressman Brian Higgin’s legal challenge to his petitions on Friday, setting up Higgins’ first primary as an incumbent. Justice Paul B. Wojtaszek, ruled that Egriu had at least twenty more signatures than required. Higgin’s attorney, Jerome Schad then conceded and agreed not to appeal the decision. Egriu’s attorney, James Ostrowski, had previously argued that Higgins’ suit would disenfranchise military voters who have already received the ballot with Egriu’s name on it.
During the case, Egriu, a local builder and community activist, accused Higgins of trying to disenfranchise minority voters since he didn’t like the way they signed Egriu’s petitions. Egriu thanked Justice Wojtaszek for accepting numerous affidavits from voters who allegedly printed their names, as these affidavits provided the margin of victory in the case. “I will be reminding the voters that Higgins talks about voting rights while his attorney tried to disenfranchise voters in court,” Egriu said.
